Terms of Agreement
1. Approval
I hereby approve that my personal information will be stored in databases belonging to Excellent Servers. The information will only be available for control purposes, and the information will not be made available for any third party.
2. Introduction
These General Terms and Conditions will be applied by Excellent Servers when using the Service made available by servers controlled by Excellent Servers. These General Terms and Conditions regulate the obligations and rights between the supplier of the Service, Excellent Servers and the receiver of the Service, the client. The client shall be a person of legal age, or a legal entity. If the client is not of legal age, its guardian will be fully responsible and will have taken part of these General Terms and Conditions. The ordering is binding. When the Order has been correctly filled in, Excellent Servers will send a confirmation of the Order to the e-mail address given by the Client. The Agreement will enter into effect when the order has been placed. When booking Servers by the hour, or any other temporary booking, Excellent Servers will post a confirmation through a personal message made available on its website. By submitting its booking, the client approves that Excellent Servers immediately begins its activation of the requested products serving under the stipulated time to withdraw from the Agreement according to the Swedish Law SFS(2000:274). The client approves that Excellent Servers begins its activation of the clients products during the stipulated time to withdraw from the agreement according to the above mentioned Swedish Law SFS(2000:274) meaning that the right to withdraw from the Agreement (in Swedish labeled “ångervecka”) will not be applied on these General Terms and Conditions.
3. General
The Services made available by Excellent Servers to its Clients are only intended for the Clients direct use. The Client is not allowed to sell, rent or transfer the Service or parts of the Service to any third party. Servers that are rented from Excellent Servers by the hours or any other temporary booking, which at the time of booking contain the text “e-s.se |” in their hostname shall at all times contain this text. The Client may not, without the explicit written consent by Excellent Servers, remove or modify the text. (so called debranding). Excellent Servers reserves the right to temporarily suspend or immediately shut down and or remove the Client from the Service if the Client violates any part of these General Terms and Conditions. Suspension or termination of the Clients account does not entitle the Client to any form of reimbursement for any amount paid for any Service.
4. Payment
Any Fees for the Services offered by Excellent Servers will be paid using the Clients account at Excellent Servers website. For more information check under ”payment” in the menu to the left.
5. Use of Service
The Client will use the Service in such way that no harm or disturbance will affect the Service or any other Clients using the Service. This includes, but is not limited to, excessive overuse of the Service in terms of generating an unusual amount of traffic or system resources. Under no circumstances may the Clients use of the Service lead to any disturbances on Excellent Servers or any other network supplier’s network or any disturbance on the internet. The use of the Service shall not break any Swedish or International Law. The Clients server information (hostname, rcon, password) may not contain any abusive, derogatory, discriminating, racist or any other disturbing statements or formulations. Excellent Servers reserves the right to decide what is considered disturbing or not. If the Client violates any of the above stated terms and conditions, Excellent Servers reserves the right, effective immediately, without any prior warning, to shut down the Clients account and access to the Service without reimbursing any payments made for the Service. The Clients are solely responsible for their use of Excellent Servers Service. Excellent Servers cannot be held responsible for the Clients use of the Service. Excellent Servers is not responsible for any content on the website and cannot guarantee its correctness. Excellent Servers cannot be held liable for any direct or indirect damages resulting out of or in connection with the Clients use of the Service. Servers ordered with passwords must be kept password protected at all times. Should Excellent Servers find any servers not password protected, Excellent Servers may immediately password protect that server or temporarily suspend the Service. If these types of incidents keep reoccurring, Excellent Servers may terminate the Clients use of the Service without any means of reimbursement for the Service. It is strictly prohibited to rent a BNC-account for the purpose of using it in any form of idledeals/idlebot. Quakenet will G/K-linea the account and the Client will not be able to use its BNC-account if it violates any of Quakenets rules. Excellent Servers will not reimburse any Clients which Quakenet have shut down due to violation or breach of its rules.
6. Security
It is the Clients responsibility to store log-in information to the Service in a safe place. Excellent Servers recommends the Client to change password on a regular basis to keep any unauthorized users from the Service. Passwords should be changed every 30 days. Excellent Servers works according to its security routines to keep any unauthorized users away from the Service and servers belonging to Excellent Servers. However, Excellent Servers cannot fully guarantee the security of the Service or the servers.
7. Security
By submitting its personal information, the Client (a physical person or a company) approves that Excellent Servers or any other party engaged by Excellent Servers, keep the personal information, including Swedish personal numbers (personnummer), as stated below. -Control of personal information submitted by the Client. -To process the Clients personal information in client registers belonging to Excellent Servers or any other party engaged by Excellent Servers, in order to be able to supply the Service - To process the Clients personal information for internal, and administrative use. - The reason for processing the Clients personal information is so Excellent Servers can supply the Service and thereby honoring its obligations according to these General Terms and Conditions. The Clients may request and, free of charge, receive information regarding the personal information that is processed by Excellent Servers and if needed correct the personal information. Any request of that kind shall be made in writing to Excellent Servers.
8. The Clients Obligations.
The Client shall indemnify, defend and hold Excellent Servers harmless from and against any and all liability and costs, in connection with or arising out of any violation or breach of any term of these General Terms and Conditions.
9. Excellent Servers limitation of liability In no event shall Excellent Servers be liable for any loss of profit, loss in revenue or any other indirect, incidental or consequential damage. The Client can only seek remedy if the Client has given Excellent Servers a message within 30 days after the Client noticed or should have noticed the reasons for seeking remedy.
10. Force Majeure If a part is not able to fulfill its obligations according to these General Terms and Conditions for reasons beyond that parties control such as, war, lightning strike, work conflict, fire, seizure, act of government or delay in services from business partners for reasons stipulated herein neither party shall be liable for a failure to perform any obligation hereunder if such failure is caused solely by circumstances mentioned above. If a party is unable to meet its obligations for a longer period than one month due to reasons stated above, each party has the right to withdraw from its obligations as stipulated in these General Terms and Conditions. However, such a withdrawal does not constitute a right to claim any reimbursements or damages.
11. Interruptions in Service.
Excellent Servers shall use reasonably efforts to remedy any malfunctions or interruptions occurring in the Service. Any interruptions or malfunctions shall be reported by mail to support@e-s.se Excellent Servers will not reimburse any malfunctions or interruptions occurring in the Service, which are shorter than three consecutive workdays, and having been reported according to the paragraph above. For temporary bookings (per hour or any other temporary booking) compensation in the form of additional time will be issued if the Service has been unavailable during a substantial period of time during the term of this General Terms and Services. Excellent Servers will not compensate for any malfunctions or interruptions that are traced to the Client or the Clients suppliers. If Excellent Servers receives such a report and remedies the problem which is caused by the Client, the Client shall reimburse and pay Excellent Servers for work hours and other costs. Any reports of malfunctions or interruptions cannot be made via IRC.
12. Term
These General Terms and Conditions are valid until further notice. Excellent Servers reserves the right to amend and/or change these General Terms and Conditions. Any amendments and or changes will enter into effect 1 month after having been published on Excellent Servers webpage www.e-s.se. The Client must regularly check for amendments and or changes.
